Terms of Service
Ethereal Tattoo Gallery Terms of Service
Effective date: 1/21/2026
1. About These Terms
These Terms of Service apply to Ethereal Tattoo Gallery ("Ethereal," "the shop," "we," or "us"), located at 730 Rigsbee Ave, Durham, North Carolina. They cover visits to the studio, use of our website at etherealtattoogallery.com, and communication with the shop through any channel, including email, text message, social media, and chat features on our Google Business Profile. By using these services or visiting the studio, you agree to these terms.
2. Individual Artist Policies
Tattoo services at Ethereal are provided by the individual artist you book with. Each artist sets and manages their own policies, including booking, deposits, pricing, cancellations, rescheduling, touch-ups, and gift cards. Before booking, please review the policies of the specific artist you plan to work with. If an artist's policy differs from these terms, the artist's policy applies to that artist's services, except for the shop-wide rules in Sections 5 through 9, which apply to every appointment at the studio.
3. Booking and Deposits
Ethereal does not take bookings or deposits at the shop level. Each artist books through their own process. All deposits are paid to, held by, and governed by the individual artist. If an artist leaves the shop, any deposit, scheduled appointment, or unfinished work is a matter between the client and that artist.
4. Guest Artists
Ethereal hosts guest artists from time to time. Guest artists set their own policies. Because guest artists work at the studio for a limited time, they may not be available for touch-ups after their visit. Please confirm touch-up arrangements with your guest artist before your appointment.
5. Age and Identification
North Carolina law (N.C. Gen. Stat. § 14-400) prohibits tattooing any person under 18 years of age. The law has no parental consent exception, and we will not tattoo anyone under 18 for any reason. All clients must present a valid, unexpired, government-issued photo ID at every appointment.
6. Shop Minimum
The shop minimum for any tattoo is $150. Final pricing beyond the minimum is set by the individual artist.
7. Health and Safety
All clients must complete and sign the shop's consent paperwork before being tattooed. We will not tattoo anyone who appears to be under the influence of alcohol or drugs. In keeping with North Carolina tattooing rules (15A NCAC 18A .3206), we will not tattoo anyone with visible jaundice, or any skin that has a rash, pimples, boils, infection, or signs of redness or inflammation. Your artist may reschedule an appointment for any of these reasons.
8. Guests in the Studio
No one under 18 is permitted in the studio, including children accompanying a client. Adult guests are welcome, but please tell your artist in advance. We want to keep distractions to a minimum for both the client and the artist, and your artist may limit the number of guests in the work area.
9. Right to Refuse Service
Ethereal and its artists reserve the right to refuse or end service to anyone at their discretion, including for reasons of health, safety, professionalism, or legal compliance, or for conduct that is disrespectful to artists, staff, or other clients.
10. Artwork and Designs
Custom designs, drawings, and sketches remain the property of the artist who created them. They may not be copied, reproduced, or taken to another artist or shop without the creating artist's written permission. By providing reference images, you confirm that you have the right to share them for this purpose.
11. Aftercare and Healing
Your artist will provide aftercare instructions. Healing results depend on many factors, including skin type, placement, and how closely aftercare instructions are followed. Questions about your healing tattoo should go to your artist. For signs of infection or a medical concern, contact a licensed health care provider.
12. Website, Messaging, and Automated Chat
Information on our website, social media, and Google Business Profile is general information only. Some messages through our Google Business Profile may be answered by an automated chat feature provided by Google. Automated answers may be incomplete, out of date, or incorrect. They are not a price quote, a booking, a confirmation of availability, medical advice, or a substitute for an artist's own policies. Pricing, availability, and appointment details are confirmed only by the individual artist. Google's chat feature is operated by Google and is also subject to Google's own terms and privacy policy.
13. Limitation of Liability
To the fullest extent permitted by North Carolina law, Ethereal is not liable for any indirect, incidental, or consequential damages arising from use of our website, social media, or messaging channels, or from reliance on general or automated information. Tattoo services are subject to the consent paperwork signed at your appointment.
14. Governing Law
These terms are governed by the laws of the State of North Carolina.
15. Changes to These Terms
We may update these terms at any time. The effective date at the top of this page shows when they were last changed.
